Mandatory retirement for firefighters upheld

The Human Rights Tribunal of Ontario has decided that a mandatory retirement provision in a firefighter collective agreement does not violate the Human Rights Code.

The Human Rights Tribunal held that the expert evidence demonstrated that there are particular factors about the occupation of firefighters that lead to an exceptionally elevated risk of cardiac events. It concluded that mandatory retirement was a reasonably way for the City of London and the London Professional Fire Fighters' Association to address those risks and that modifying the provision would cause undue hardship. As a result, there was no violation of the Code.
